Voter Registration in 353 Counties in 29 States Exceeds 100% of Eligible Voters -- Says Judicial Watch

Judicial Watch has long been working to force reluctant local and state governments to comply with the federal law that requires them to keep accurate voter registration rolls.  This is a critical task if we are to have legitimate elections and it is one of several reasons why I am a Judicial Watch contributor.
Judicial Watch has released an updated study of the problem.  This problem is especially acute when the states are sending out mass mailings of ballots to everyone on the absurdly inflated voter registration rolls.  The highlights of the results follow from an email I just received from Judicial Watch:
Voter Registration in 353 Counties in 29 States Exceeds 100%

In 2018 the Supreme Court upheld a voter-roll cleanup program that resulted from our settlement of a federal lawsuit with Ohio. California settled a NVRA lawsuit with us and last year began the process of removing up to 1.6 million inactive names from Los Angeles County’s voter rolls. Kentucky also began a cleanup of hundreds of thousands of old registrations last year after it entered into a consent decree to end another Judicial Watch lawsuit. In September 2020, we sued Illinois for refusing to disclose voter roll data in violation of Federal law.
So we’ve been busy and effective. Unfortunately, the problem persists.
Our newly released study reveals that 353 U.S. counties had 1.8 million more registered voters than eligible voting-age citizens. In other words, the registration rates of those counties exceeded 100% of eligible voters. The study finds eight states showing statewide registration rates exceeding 100%: Alaska, Colorado, Maine, Maryland, Michigan, New Jersey, Rhode Island, and Vermont.

The September 2020 study collected the most recent registration data posted online by the states themselves. This data was then compared to the Census Bureau’s most recent five-year population estimates, gathered by the American Community Survey (ACS) from 2014 through 2018. ACS surveys are sent to 3.5 million addresses each month, and its five-year estimates are considered to be the most reliable estimates outside of the decennial census.
Our latest study is necessarily limited to 37 states that post regular updates to their registration data. Certain state voter registration lists may also be even larger than reported, because they may have excluded “inactive voters” from their data. Inactive voters, who may have moved elsewhere, are still registered voters and may show up and vote on election day and/or request mail-in ballots.
We rely on our voter registration studies to warn states that they are failing to comply with the requirements of the National Voter Registration Act of 1993, which requires states to make reasonable efforts to clean their voter rolls. We can and have sued to enforce compliance with federal law.
Earlier this month, we sued Colorado over its failure to comply with the National Voter Registration Act. In our new study, 42 Colorado counties—or two thirds of the state’s counties—had registration rates exceeding 100%. Particular data from the state confirms this general picture. As the complaint explains, a month-by-month comparison of the ACS’s five-year survey period with Colorado’s own registration numbers for the exact same months shows that large proportions of Colorado’s counties have registration rates exceeding 100%. Earlier this year, we sued Pennsylvania and North Carolina for failing to make reasonable efforts to remove ineligible voters from their rolls as required by federal law. The lawsuits allege that the two states have nearly 2 million inactive names on their voter registration rolls. We also sued Illinois for refusing to disclose voter roll data in violation of Federal law.
Our study updates the results of a similar study from last year. In August 2019 we analyzed registration data that states reported to the federal Election Assistance Commission (EAC) in response to a survey conducted every two years on how states maintain their voter rolls. That registration data was compared to the then-most-recent ACS five-year survey from 2013 through 2017. The study showed that 378 U.S. counties had registration rates exceeding 100%.
The new study shows 1.8 million excess, or ‘ghost’ voters in 353 counties across 29 states. The data highlights the recklessness of mailing blindly ballots and ballot applications to voter registration lists. Dirty voting rolls can mean dirty elections.

My Comments:

One of the reasons the Democratic Party opposed the Citizenship question on the 2020 Census so adamantly is because the only way the Census population can be used in the future to spot obviously bloated voter registration polls is if the registered voters exceed the sum of the age-eligible citizens and the same age range of non-citizens, who cannot legally vote.  The Democratic Party, for all its pretense of claiming that every vote must count, has long had a strongly vested interest in inflated voter registration rolls.  Of course, every legal vote is watered down when the dead, the out of district, and non-citizens vote in an election.  The Democratic Party is not concerned with this.

"CHOOSE YOUR LIAR" DEMOCRACY

The final weeks of a presidential campaign is one of the best opportunities to view political perfidy in spectacular colors. While the media lectures Americans about their civic duty to vote to save the nation, the candidates continue conniving nonstop with no respect for the facts or decency. After the election is settled, the media and the political establishment will announce “the system worked” and Americans must again respect and obey their rulers (unless Trump is re-elected, of course).

Politicians have mandated warning labels for almost everything except voting booths. Federal agencies require full disclosure of risks for everything from mortgages to volunteering for medical experiments. People are entitled to far more information when testing baldness cures than when casting votes that could lead to war.

Hopefully Americans will not be as gullible after the election as many are before casting their ballot. Dishonesty is the distinguishing trait of the political class, going all the way back to ancient Athens and the satirical plays of Aristophanes. In 1799, Thomas Jefferson observed, “Whenever a man casts a longing eye on offices, a rottenness begins in his conduct.” 

A successful politician is often merely someone who bamboozled more voters than the other liar running for office. Political campaigns rely on deception because, as economist John Burnheim explained, “Overwhelming pressures to lie, to pretend, to conceal… are always present when the object to be sold is intangible and its properties unverifiable until long after the time when the decision to buy can be reversed.”

 Lying has long been part of presidents’ job description: the names of Lyndon Johnson and Richard Nixon practically became synonyms for deceit. Former president George W. Bush is being rehabilitated by the media nowadays. But Bush made “232 false statements about weapons of mass destruction in Iraq and another 28 false statements about Iraq’s links to Al Qaeda,” as the Center for Public Integrity reported. Bush’s determination to dishonestly drag America into another Middle East war led to the deaths of more than 4,000 American troops and hundreds of thousands of Iraqi civilians.

President Barack Obama received sainthood even before his election and he retained his halo even though he falsely promised dozens of times that people could keep their doctor after Obamacare’s decrees took effect. Obama campaigned in 2008 on a peace platform and then bombed seven nations. Obama promised “no more illegal wiretapping” but he unleashed the National Security Administration to target any American “searching the web for suspicious stuff.”

The 2016 presidential race was a landmark: never before had American voters been obliged to choose between two such widely despised candidates. Routine deceit by both candidates helped make “post-truth” the 2016 word of the year according to the Oxford English Dictionary.

The 2020 race is also deluging voters with near-record levels of malarkey. Joe Biden denied referring to American soldiers as “stupid bastards” (despite a video of his spiel), denies that his son Hunter has done anything wrong (despite the pesky laptop emails), and exaggerated the Covid death toll a hundredfold. Trump has ludicrously portrayed his pandemic response as faultless, wildly exaggerates the economic achievements of his administration, and perennially denies the damage inflicted here by his trade wars. The one certainty is that the 2020 election will not be won by an honest man. 

If a new president is elected next month, the media will insist that “this time is different” and that Americans can safely trust the White House again. In reality, Election Day merely marks a brief intermission between campaigning lies and governing lies. Yet, if Biden wins, Americans will be encouraged to pretend that election victories expunge the sins – or at least the character defects – of triumphant politicians. Winners supposedly deserve a “honeymoon” where people pretend they are trustworthy enough to enact new laws and launch ruinous new federal programs.

But nothing happens after Election Day to make politicians less venal. Presidents and members of Congress take oaths to uphold and defend the Constitution. But, as former U.S. senator Bob Kerrey explained in 2013, “The problem is, the second your hand comes off the Bible, you become an asshole.” When elected officials scorn the Constitution, politics becomes little more than promising and pilfering. 

America is increasingly a “Garbage In, Garbage Out” democracy. Politicians dupe citizens and then invoke deluded votes to sanctify and stretch their power. In the post-9/11 era, politicians treat Americans like medical orderlies treat Alzheimer’s patients, telling them anything that will keep them subdued. It doesn’t matter what untruths the people are fed because they will surely forget them.

Lies subvert democracy by crippling citizens’ ability to rein in government. As Willie Brown, the former mayor of San Francisco and mentor for Vice Presidential candidate Kamala Harris, said, “In politics, a lie unanswered becomes truth within 24 hours.” Any lie accepted by a sufficient number of ignorant voters becomes a political truth.

Disregarding political lies paves the way for official crimes. As former New York City mayor Michael Bloomberg declared, “When we tolerate dishonesty, we get criminality.” If elected politicians can lie and cover up their actions, then how can any reasonable person not expect to be oppressed?

Politicians assure that voters’ apparent consent is irrevocable regardless of how many lies permeated election campaigns. But there is no such thing as retroactive self-government. Belatedly exposing political lies does nothing to resurrect lost freedoms. 

Deceiving voters is as much a violation of their rights as barring them from the polling booth. Only if we assume that people consent to being lied to can pervasive political lies be reconciled with democracy. And if people consent to deceit, elections become little more than patients choosing who will inject their sedatives.

President Obama, in his January 2017 farewell address, criticized Americans who “blame the leaders we elect without examining our own role in electing them.” By Obama’s standard, the perpetual perfidy of the political class would justify condemning voters almost regardless of how they cast their ballots. Obama also condemned people who did not vote. Obama thereby created a no-win situation – except for politicians. 

Obama, in his 2016 speech to the Democratic National Convention, also declared, “We do not look to be ruled.” Regardless of the irony of a heavy-handed ruler tossing out that line, it rings true for tens of millions of Americans who make their own liberty their supreme political value. 

In the short run, the political game is rigged so that winners capture far more power than many, if not most, Americans would willingly cede to them and vastly more than the Constitution permits. But citizens can reduce the hazards they face by remembering that winning votes never redeemed a rascal. The winner of next month’s presidential election will be a clear and present danger to Americans’ rights and liberties regardless of his margin of victory.

Will Democracy's Myths Doom Liberty?

The Supreme Court declared in 1943, “There is no mysticism in the American concept of the State or of the nature or origin of its authority." In reality, the cardinal doctrines of contemporary democracy are layer upon layer of mystical claptrap. The phrases which consecrate democracy seep into many Americans’ minds like buried hazardous waste.
If Joe Biden wins the presidential election, voters will be told that our political system is redeemed: the “will of the people” is now clear, Biden will rule with “the consent of the governed,” and Americans are obliged to again trust and obey the federal government. If Donald Trump is reelected, much of the same media will continue howling about imaginary Russian plots. But these notions remain dangerous delusions regardless of who is declared the winner on Election Day.

The notion that election results represent the “will of the people” is one of the most shameless triumphs of democratic propaganda. Rather than revealing the “will of the people,” election results are often a one-day snapshot of transient mass delusions. Votes which only reveal comparative contempt for competing professional politicians are transmogrified into approvals for blueprints to forcibly remake humanity.
Americans are encouraged to believe that their vote on Election Day somehow miraculously guarantees that the subsequent ten thousand actions by the president, Congress, and federal agencies embody “the will of the people.” In reality, the more edicts a president issues, the less likely that his decrees will have any connection to popular preferences. It is even more doubtful that all the provisions of hefty legislative packages reflect majority support, considering the wheeling, dealing, and conniving prior to final passage. Or maybe the Holy Ghost of Democracy hovers over Capitol Hill to assure that average Americans truly want every provision on every page of bills that most representatives and senators do not even bother reading?
A bastard cousin of the “will of the people” flimflam is the notion that citizens and government are one and the same. President Franklin Roosevelt, after five years of expanding federal power as rapidly as possible, declared in 1938, “Let us never forget that government is ourselves and not an alien power over us.” President Johnson declared in 1964: “Government is not an enemy of the people. Government is the people themselves,” though it wasn’t “the people” whose lies sent tens of thousands of American conscripts to pointless deaths in Vietnam. President Bill Clinton declared in 1996, “The Government is just the people, acting together—just the people acting together.” But it wasn't “the people acting together” that bombed Serbia, invaded Haiti, blockaded Iraq, or sent the tanks in at Waco.
President Barack Obama hit the theme at a 2015 Democratic fundraiser:
Quote:“Our system only works when we realize that government is not some alien thing; government is not some conspiracy or plot; it’s not something to oppress you. Government is us in a democracy.”
But it was not private citizens who, during Obama’s reign, issued more than half a million pages of proposed and final new regulations and notices in the Federal Register; made more than 10 million administrative rulings; tacitly took control of more than 500 million acres by designating them “national monuments”; and bombed seven foreign nations. The “government is the people” doctrine makes sense only if we assume citizens are masochists who secretly wish to have their lives blighted.
Presidents perennially echo the Declaration of Independence's appeal to “the consent of the governed.” But political consent is gauged very differently than consent in other areas of life. The primary proof that Americans are not oppressed is that citizens cast more votes for one of the candidates who finagled his name onto the ballot. A politician can say or do almost anything to snare votes; after Election Day, citizens can do almost nothing to restrain winning politicians.
A 2017 survey by Rasmussen Reports found that only 23 percent of Americans believe that the federal government has “the consent of the governed.” Political consent is defined these days as rape was defined a generation or two ago: people consent to anything which they do not forcibly resist. Voters cannot complain about getting screwed after being enticed into a voting booth. Anyone who does not attempt to burn down city hall presumably consented to everything the mayor did. Anyone who does not jump the White House fence and try to storm into the Oval Office consents to all executive orders. Anyone who doesn't firebomb the nearest federal office building consents to the latest edicts in the Federal Register. And if people do attack government facilities, then they are terrorists who can be justifiably killed or imprisoned forever.
In the short term, the most dangerous democratic delusion is that conducting an election makes government trustworthy again. Only 20 percent of Americans trust the government to “do the right thing” most of the time, according to a survey last month by the Pew Research Center. Americans are being encouraged to believe that merely changing the name of the occupant of the White House should restore faith in government.
If Biden is elected, we will hear the same “redemption” storyline that was trumpeted when Obama replaced (temporarily) disgraced George W. Bush. The same media that ignored Biden’s corruption during the presidential campaign will insist that his inauguration purifies Uncle Sam. With Biden in charge, pundits and pooh-bahs will swear that it is safe to expand federal control over healthcare, education, housing, the economy, the environment, and anything else that moves.
But the benevolence of government rarely transcends the perfidy of politics. Washington will remain as venal as ever, regardless of the hallelujah chorus of PBS NewsHour panelists. When scandals erupt, citizens will be told to trust politically approved fixes to the system—even though most Washington reforms are like fighting crime by hiding the corpses of victims.
It is time to demystify democracy. The surest effect of exalting democracy is to make it easier for politicians to drag everyone else down. Until presidents and members of Congress begin to honor their oath to uphold and defend the Constitution, they deserve all the distrust and disdain they receive. Americans need less faith in democracy and more faith in their own liberty.

ON COURSE FOR A COUP
CORONAVIRUS HYSTERIA AND THE US ELECTION

Even the pundit class admits that the coming presidential election in the United States is shaping up to be an event like no other.
“We’re in such a unique time that you don’t know what the next week is going to bring,” burbled Harry Enten, an “analyst” for CNN, on October 15 about the impending face-off between incumbent Donald Trump (a man who can’t even make his hair look plausible) and Clueless Joe Biden, former Vice President of Vice and/or Senator from Senescence. “This is the most insane freakin’ thing in the entire world.”
Close, Mr. Enten. But no cigar.
Because, you see, there’s every reason to worry that the impending election isn’t going to be an election at all. Though no mainstream commentator will say so out loud, the most important single fact about this contest is that it very possibly won’t determine the identity of the next president. Both major political parties – despite their shrill disagreements over a whole host of pseudo-issues – seem united in their determination to prevent a decisive result. And in the process, they’re edging dangerously close to delegitimizing the electoral system itself.
Which means, in plain language, that we may be heading for a coup.
Now, a problem on that scale should not have to be whispered from the margins. But popular media steadfastly refuse to discuss the subject – and their silence speaks volumes about the sort of government our pundits actually favor, which (whatever their pretensions to the contrary) has little or nothing to do with democracy.
That’s the elephant in the room, folks. And if you’re not worried, you should be.
Remember: this is the first American election held under the shadow of King Corona; and if there’s one thing our public intellectuals have made clear over the last seven months, it’s that pedestrian details like constitutional “due process” or representative government count for nothing against our ruling class’s autocratic prescriptions for the public health. Since March, a relentless series of edicts have turned state governors into virtual dictators, destroyed tens of millions of jobs, trashed the Bill of Rights, promoted political censorship of social media and made a bad joke of medical priorities – all for our own good, of course.
Why should democratic elections be immune from the same treatment?
Oh yes, there are persistent mutterings that Donald Trump may refuse to “concede” the election, if (as polls predict) Joe Biden somehow manages to navigate to victory through the murky waters of his own incomprehension. But this is mere chatter. No law requires a candidate to “concede,” and no one even casually familiar with Trump’s record would expect him to do any such thing, no matter what happens on or after election night.
But while formal concessions are dispensable, two other things are not. First, each presidential election must cross certain legal thresholds – and must do so by specific deadlines – in order to facilitate the balloting of an Electoral College. Second, and perhaps even more important, the electoral process must be accepted as legitimate by the people who are to be governed by it.
Can we count on either requirement being met this time around?
True, at least since the Hayes-Tilden debacle of 1876, the necessary conditions have been satisfied so readily that they’ve never become public issues. But today we face a mainstream media that is running at full anti-democracy throttle – smearing defenders of civil rights as a “death cult,” while ignoring more than forty state governors as they upend the Constitution with a spree of unilateral diktats. Under these conditions, what’s to stop the powers that be from claiming legal grounds to derail the election of 2020 altogether – and then shoehorning into office whatever corporate shill can be installed with a minimum of squawking from an already cowed populace?
Make no mistake: both political parties are shoring up the groundwork for just such a denouement.
That Trump and his fellow gangsters are dishonest enough to reject an adverse election result need hardly be said. As I write this, the same Republican senators who piously insisted that Barack Obama had no right to appoint a Supreme Court justice in the last year of his term are ramming through the confirmation of a cult-worshiping crackpot to that same court in the final weeks of Donald Trump’s. If Trump loses on November 3, we can expect Mitch McConnell and his minions to block or delay the convening of the Electoral College past its legal deadline, and then to deadpan to the press that the election doesn’t count because it didn’t finish in time.
And the Democrats? Well, maybe it’s too much to expect that the champions of an old plagiarist who has trouble remembering the name of the office he’s running for would put up any principled opposition to a threatened coup. But McConnell himself could hardly have asked for a more perfect dance partner in his This-Is-No-Real-Election two-step. By insisting on an unprecedented and risky regime of massive mail-in voting, the Democrats have virtually guaranteed two things: that Republicans will claim fraud if their candidate appears to be on the losing side; and that, even under the best of circumstances, the counting of the ballots will be slow and complicated enough to stir public doubts about the certainty of the result.
That would be bad enough in any election. In this one, it could be disastrous. What with all the pundits and the tame “experts” screaming at us that if we don’t obey Big Brother we’ll all drop dead, it’s quite possible that the public will acquiesce in a coup if the Right Thinkers tell us that elections aren’t good for us and that our job is to “stay safe” at home while they decide how to govern our country for us.
In fact, if you ask me, they’re already halfway there. The closer we get to Election Day, the more intense and invasive is the bludgeoning of the fear porn. According to the latest propaganda, inviting family members to his home to watch movies – yes, to watch movies! – was enough to make a Trump supporter guilty of mass murder. A magically-timed Hulu documentary, Totally under Control, ushers us to the polls with the claim that Trump’s “relentless downplaying” of the virus “led us to where we are now, with a devastated economy and more than 200,000 Americans dead.” (Boy, “downplaying” must be potent stuff.) Even small children are being dragged into the terror campaign: where I live, Halloween trick-or-treating has just been banned “due to the safety concerns regarding COVID19.”
The more pretentious among us may have missed those tidbits, but they can still get their propaganda fix from the strait-laced Public Broadcasting System. A few days ago, PBS’s mouthpiece Judy Woodruff demanded of Francis Collins, director of the National Institutes of Health, how he plans to save Americans from extinction now that one state (Wisconsin) is actually considering allowing people to walk around without muzzles. The good doctor deplored such moral laxity, of course, hinting broadly that “people are dying” because of (you guessed it) Donald Trump, who committed the unpardonable sin of insulting Anthony Fauci, that “wonderful communicator.”
And what makes the coronavirus so uniquely “significant and very serious”? Well, it seems that in the week leading up to the interview there had been “more than 775 deaths [of people with COVID19] a day.” Never mind that 1,800 people in the U.S. – more than twice that number – die every day from heart disease. “Hey, we’re Americans. We’re not stupid,” Dr. Collins concluded cheerfully. We know the Black Death when we see it. Or if we don’t – well, then, we obviously need a new President.
So please, if the upcoming election is replaced by a putsch, let’s not say we had no warning. A canceled presidential election would be a new and ugly reality. So would street violence over the legitimacy of the balloting.
But the assault on democracy, under cover of coronavirus hysteria, has been building steadily for months. The whole mail-in voting travesty, which may lead to a coup at the highest levels of U.S. government, is only one element of a larger and only slightly less dramatic coup that sprouted at the state level last March and has been slowly sweeping away democratic principles ever since.
The sidelining of legislatures, “executive orders” issued in the absence of any emergency, mass house arrest without a warrant, “quarantines” without court orders, the wholesale destruction of small businesses in the absence of any legal recourse, restraints on public demonstrations, the censorship of dissent – all of these were not only evils in themselves, but were ominous harbingers of an even more drastic attack on the principle of popular government.
And our so-called liberals knew all along what sort of false fire they were playing with. Even the Atlantic, one of the most consistent organs of coronavirus propaganda, now concedes that all the hysteria about deadly voting booths was groundless – that, in fact, “voting with a mask on is no more dangerous than going to a grocery store with a mask on – something millions of Americans do every week.” Actually, masks have no provable effect on viral transmission in the first place, so the upshot of the Atlantic’s admission is that the whole scare campaign about normal voting – like nearly everything else the “experts” have been yelling at us – was a fraud. And it was a fraud that only strengthened the case for an invalidated election, a fact that was staring the Democrats in the face when they started bleating for mail-in voting. Either they were unpardonably stupid, or – as I tend to think – they were getting tired of democracy and were just about ready to pick the next President in a back-room deal with other political rainmakers.
I hope my fears about the jettisoning of the electoral process prove to be premature. But the American public has never had a more tenuous grasp on the traditional institutions of democracy than it does now. With four-fifths of our governors already acting like dictators, with both major parties working hand in hand to delegitimize the election of a president, and with a mass media that stubbornly refuses to report these facts, we won’t preserve democracy by doing nothing.
The constitutional system may not collapse in a week’s time. But if we don’t want to see it collapse sooner or later – and probably sooner – we had better start taking politics into our own hands.
Bleak as our prospects may seem now, the alternatives are bound to be worse.
