Dear (XXX)

I am writing to yourself, as I have been informed by (XXX) that I must receive the Covid19 vaccine, or face disciplinary action.

As I have made very clear to (XXX), I am declining all forms of the Covid19 vaccine under ethical reasons.

There are no statutory provisions that can force individuals to become vaccinated. The Public Health (Control of Disease) Act 1984 specifically states that members of the public should not be compelled to undergo any mandatory medical treatment, including vaccinations. Forcing, coercing or manipulating an employee to receive a vaccine is in breach of article 8 of the European Convention on Human Rights, which protects people from being interfered with physically or psychologically and includes mandatory vaccinations. Forced vaccinations in the workplace, is not only a human rights concern, but also has criminal implications. Forcing anyone to receive a vaccine injection under duress, under UK law, constitutes an unlawful injury. A vaccination requires an individual’s informed and voluntary consent, which you do not have of mine.

I want to make it very clear, that I am NOT placing any persons at risk by declining this vaccine, but I am protecting my health and my wellbeing. Declining this vaccine does NOT mean that I can not perform my job effectively and I will not be resigning.

In accordance of  the Employment Rights Act 1996 and Section 6 of the 2010 Equality act, I am protected from being sacked or chosen unfairly for redundancy and I am safeguarded against unlawful discrimination by my employer.

When signing my work contract, I did not agree for any testing, vaccine or interventions.
I enjoy my job and I would like to keep this as civil as possible, but as per my rights, I will be taking legal action via The ACAS Code of Practice on Disciplinary and Grievance Procedures if I receive disciplinary action because of this.

the covenants and agreements contained in this Agreement and other good and valuable consideration, the receipt of which is hereby acknowledged, the parties to this Agreement agree as follows:



1. Consideration

Accepting liability for any ‘COVID/CORONAVIRUS/SARS-COV-2/ANY OTHER VACCINE NOT MENTIONED’ vaccine damage that occurs includes, but not limits to - Panniculitis; atypical measles; fever; syncope; headache; dizziness; malaise; irritability, vasculitis, pancreatitis; diarrhoea; vomiting; parotitis; nausea, thrombocytopenia; purpura; regional lymphadenopathy; leukocytosis, anaphylaxis, anaphylactoid reactions, angioedema (including peripheral or facial edema) and bronchial spasm, arthritis; arthralgia; myalgia, encephalitis; encephalopathy; measles inclusion body encephalitis (MIBE) subacute sclerosing panencephalitis (SSPE); Guillain-Barré Syndrome (GBS); acute disseminated encephalomyelitis (ADEM); transverse myelitis; febrile convulsions; afebrile convulsions or seizures; bell’s palsy, ataxia; polyneuritis; polyneuropathy; ocular palsies; paresthesia, pneumonia; pneumonitis; sore throat; cough; rhinitis, Stevens-Johnson syndrome; acute hemorrhagic edema of infancy; Henoch-Schönlein purpura; erythema multiforme; urticaria; rash; measles-like rash; pruritus; injection site reactions (pain, erythema, swelling and vesiculation), nerve deafness; otitis media, retinitis; optic neuritis; papillitis; conjunctivitis, epididymitis; orchitis and death. All of which are listed as side effects on the safety data sheets.

6. The Releasee accepts that failure to sign this document is full confirmation that the vaccine will not be given to the (ELDERLY RELATIVE)

The Releasee acknowledges that any ‘COVID/CORONAVIRUS/SARS-COV-2/ANY OTHER VACCINE NOT MENTIONED’ has never been deemed completely safe or effective and that by vaccinating (ELDERLY RELATIVE), it is taking a potentially fatal risk. The Releasee accepts that there is no supporting  evidence to say that vaccines are safe and the US Supreme Court has deemed vaccines ‘Unavoidably unsafe.” The Releasee acknowledges this and takes full medical and financial liability.

8. Full and Final Settlement

9. The Releasee further understands and acknowledges that the Releasor may suffer injuries or complications unknown at the time directly after vaccination but agrees that the Releasee will take full financial, medical and civil liability for the entirety of (ELDERLY RELATIVE) life.

10. It is declared that the terms of this settlement are fully understood; that the amount or type of consideration stated is the sole consideration for this Agreement and that the sum is accepted voluntarily for the purpose of making a full and final compromise, adjustment and settlement of all claims for injuries, losses and damages resulting or which may result from (ELDERLY RELATIVE) being forcibly vaccinated against the families wishes.

11. This Agreement contains the entire agreement between both parties and the terms of this Agreement are contractual and not a mere recital.

12. No Admission of Liability

13. It is agreed that the Releasor will take no further action against the Releasee if (HE/SHE) diminishes his case in wanting to vaccinate (ELDERLY RELATIVE)

14. Governing Law

15. This Agreement will be governed by and construed in accordance with the laws of the Country of (YOUR COUNTRY)

I am writing to you regarding my daughter, [name], who is due to return to year [number] in September. [Name] has been very happy at [school name] and is looking forward to returning next month. Thanks to you and the other staff for everything you've done to make her journey there so far a happy one.

However, both she and I have some concerns that we would like to address in writing before term commences. In the first instance and as you know, I do not consent to vaccines for [name], and now that she is approaching an age where she may be considered Gillick competent, it is important to underline she does not consent to them, either. She understands the risks and benefits of vaccinations, and chooses not to receive them. Affixed to this letter is a short written statement from [name] confirming this. I know that there can sometimes be confusion on vaccination days and children who have been opted out of vaccination nevertheless receive them, and that Sometimes all vaccination days happen without warning, so I just felt for extra peace of mind for me and [name], we would make clear our position formally and in writing before term begins.

Leading on from this are the other protocols the school may be putting in place as a response to the coronavirus situation. I do not feel that schools are the place for medical processes to take place, and I only allow trusted healthcare professionals to conduct medical procedures on my daughter. Therefore, I do not consent to my daughter receiving any coronavirus testing at school. If she develops symptoms of illness, I will keep her at home as I would with any other illness, and arrange any necessary testing or treatment myself.

I also do not consent to my daughter using hand sanitiser. Hand sanitisers contain powerful chemicals that permeate the skin and enter the bloodstream, as well as being implicated in causing dermatitis and destroying vital beneficial bacteria on the skin - essential for maintaining a strong immune system. I do not consent to this product being used on my daughter for any reason, and only consent to her washing her hands with conventional soap and water.

If the school intends to temperature-check the children, I do not consent to my daughter being tested at the forehead with an infrared thermometer gun. I am not comfortable with the psychological connotations of my daughter repeatedly having a gun pointed at her head, and there may also be short and long-term safety issues with aiming this instrument directly at a developing brain. Therefore, I only consent to my daughter being temperature checked at the wrist.

My daughter and I also do not give our consent to participating in the NHS track and trace scheme, and do not want our contact details passed over to the NHS or any other agency for the purposes of tracking and tracing. Any agency having or using our data without our consent is in breach of the GDPR and therefore illegal.

I do not know what the school's policy will be on mask-wearing, but I wish to make clear the legal position on masks, which is that those suffering hidden disabilities are exempt, and under the Equalities Act 2010 and Disabilities Discrimination Act, it is illegal to ask someone if they have a hidden disability or what it is. Therefore, were the school to mandate masks, it would be illegal for them to ask any pupil why they were not wearing one. It would also be incumbent on the school to instruct all pupils and staff on the law regarding masks and exemptions, to ensure nobody without a mask is discriminated against, which is illegal under the Equalities Act and could result in the school being sued.

Finally, I do not consent to any detainment of my daughter on school premises or elsewhere for any reason. I expect her to return home at the usual time every day unless I have given my express permission otherwise.

Please reply to this letter at your earliest possible convenience acknowledging my concerns and agreeing that my daughter will not be subject to any measures I have not expressly offered my consent for.

COVID-19 Vaccination
 
I am writing to you in connection with your proposal to require all care home workers to give details of their COVID-19 vaccination status, or details of their clinical exemption from vaccination.
My position is that this effectively amounts to a request by you, for me to have a COVID-19 vaccination to remain employed with you on my current terms. You have indicated that employees who declare that they are not vaccinated, will have their employment duties altered.
You state that your position is a requirement in law under The Health and Social Care Act 2008 (Regulated Activities) (Amendment) (Coronavirus) Regulations 2021, (“the Regulations”). Consequently, you claim me having a COVID-19 vaccination or declaring my vaccination status, is now a requirement of my employment with you.
That the Regulations have been laid by statutory instrument does not mean that they are without contest. There is likely to be a legal challenge in the coming weeks on the basis that the Regulations are in contravention of both domestic and international law, particularly with respect to human rights. The Regulations also breach common law rights enshrined in UK case law. Given this, I do believe you cannot rely on citing the Regulations as a valid basis for requiring me to have a COVID-19 vaccination.
 
In addition, my contract of employment with you does not state that it is a requirement that I be vaccinated with a COVID-19 vaccination, or that I need to declare my vaccination status to you. You cannot change my contract without my agreement, and therefore to try and force a change by threatening me with job loss or change of duties, if I do not take a COVID-19 vaccination or declare my vaccination status to you, is in breach of my contract.
Under current employment law I am protected from being dismissed, or having my duties altered, due to any personal decision not to have a COVID-19 vaccination and/or declare my vaccination status to you. I could claim constructive or unfair dismissal, as any decision to end or alter my employment could be found unreasonable as it could be seen as: -
 1. a way of compelling me to have the vaccination, falling short only of forcing a needle into my arm, which any employment tribunal would struggle to justify.
2. in breach of various articles of the Human Rights Act
3. in breach of UK domestic law
4. overreaching my genuine and reasonable fears about harms I may befall if I have a COVID-19 vaccination
5. discrimination in breach of the Equality Act 2010, as my reasons for refusal of the COVID-19 vaccine are related to my religious, spiritual, and philosophical beliefs. This may therefore give rise to a claim that I am being treated less favourably than other employees because of my refusal
6. constituting a criminal offence for which you will be personally liable, or bring you within liability under tort, by compelling a person to take a medicine, or to have any form of treatment, without meeting the requirements of obtaining full informed consent for the same. The right to full informed consent is enshrined in common law via decisions handed down by the UK Supreme Court
 
The above points are explained, in the context of domestic and international legislation and case law, by the enclosed Explanatory Notes document, which can also be downloaded from https://awakenedworld.co.uk/wp-content/uploads/2021/08/Explanatory-Notes-for-Care-Home-Managers-and-Owners.pdf. I recommend that you read this document fully, as the legislation and case law cited will form the basis of any claim I will make, should my employment be threatened in any way.
 
Threatening my employment includes, but is not limited to:
 
Restricting my duties and preventing me from being client facing
Attempting to terminate my contract of employment
Placing me under the company’s disciplinary procedure
 
I would therefore like to make clear that any attempt to dismiss me from my role, redeploy me to non-client facing duties, or indeed place me under the firm's disciplinary procedure, will result in me seeking independent legal advice and taking appropriate action to protect my employment position.
 
I reserve my right to take action against you personally as the care home manager, as well as take action personally against the care home owner, (who I consider would be vicariously liable in such a matter), for any loss of income or other detriment to my employment status, as well as any other damages that I incur.
 
This is the only letter that I will send in connection with this issue, before taking appropriate legal advice.
 
Please acknowledge receipt of this correspondence within 14 days of the date cited above and ensure that it is placed on my personnel file.
