This refers to criminal intent and the state of mind required to convict a person of certain offences. Look it up and don't always believe those that you think you can trust, that you are guilty - motivation can be the difference between being found guilty or innocent.

On trial day, if the witness isn't present, get their evidence taken out. Do not agree to an adjournment which gives the prosecution another chance to produce the witness.
