We are seeking views on proposed guidance to help providers self-assess whether they need to notify to Ofcom as video-sharing platforms, under new statutory rules.
Video-sharing platforms (VSPs) are a type of online video service which allow users to upload and share videos with the public. On 1 November 2020, the Audiovisual Media Services (“AVMS”) Regulations came into force, establishing new rules in the Communications Act 2003 for UK-established VSPs.
There are specific legal criteria which determine whether a service meets the definition of a VSP, and whether it falls within UK jurisdiction. VSPs are responsible for self-assessing whether they meet these criteria; those that do will be formally required to notify to Ofcom between 6 April and 6 May next year.
Our proposed guidance is intended to help video-sharing platforms to make this assessment. We are now seeking views from interested or affected parties on our draft guidance by 5pm on 14 January 2021.
We expect to publish final guidance, taking into account stakeholder feedback, in advance of the 6 April notification window opening. After 6 May 2021, any new services must be notified to Ofcom before they launch in the UK.
